Before proceeding with any type of renovation you should get a location certificate from a surveyor to accurately determine the house location on the lot.
If the house encroaches on the alley and a major renovation is planned(ie the house is not destroyed beyond 75% of it’s value and retains existing footprint) then the applicant would need to apply for an encroachment agreement prior to Building Permit to ensure liability etc is not the responsibility of the City. The total cost of this is approximately $1500.
If the house is not encroaching on the alley but is not compliant with setbacks then a variance is not required unless the footprint is changed or height is added. Basically, if the non compliance becomes larger, either up or out, then a variance would be required.
If the house is to be destroyed beyond 75% then the new home would need to comply with the relevant setbacks of the zone (See Zoning image for setbacks). A variance would be permitted depending on the proposal. Council is not keen on granting variances for new buildings except in very extenuating circumstances. There are many good examples in town of small homes being built on small lots without the need for variances.
Could the owner could sell the two unencumbered lots separate? As there is no parking for the existing house, the City would not support this.
Does the zoning allow for an Air B and B in that location with property business licencing? No the current zoning does not allow for Air BnB. See City STR information for re-zoning application process.
Are there any issues with accessing the back property off the lane? No issue accessing the property from the lane. The lane is maintained by the City.
Can I put a carriage house on the back lots? Possibly, but I would doubt that a carriage house in that location would be able to satisfy all the requirements of the zoning bylaw for carriage houses.
